The terms behind
every Machine we supply.
These Conditions form the contract for every Flashforge WaxJet Machine we sell and come with every Quote. They explain what you get, what you pay and when, and how we look after each other if something goes wrong.
Conditions of Sale: Machines and Equipment · Last updated 2 October 2026
Payment
You pay the full price after accepting the Quote, before we order from Flashforge.
Changed your mind?
Cancel before we place the order with Flashforge and you get everything back.
Delays
Lead times are estimates. If we run more than 12 weeks late, either of us can cancel and you get a full refund.
Your rights
Nothing in these Conditions takes away your rights under the Australian Consumer Law.

About these Conditions
1.1 These Conditions of Sale: Machines and Equipment (Conditions) apply when 3D Werk (ABN 68 663 371 015), of Sydney NSW (we, us, our) sells you a Machine. They also apply to Parts and Consumables supplied under the same Quote. "You" means the customer named in the Quote.
1.2 These Conditions come with every Quote. By accepting a Quote, you agree to them.
1.3 Nothing in these Conditions excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot lawfully be excluded, restricted or modified. If any part of these Conditions could be read that way, it is read down so that it does not.
1.4 If documents conflict, they apply in this order: the Quote (as accepted by you), then these Conditions, then the other documents referred to in these Conditions (the Warranty, the Service Plan Terms, our Shipping, Delivery and Installation Policy and our Privacy Policy).
1.5 Your own purchase order or standard terms do not form part of our contract unless we both sign a document that says so. A purchase order can still identify the Goods, quantities and delivery details.

Definitions
2.1 In these Conditions:
ACL means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Business Day means a day other than a Saturday, Sunday or public holiday in New South Wales.
Consumables means wax and other materials used up in printing.
Consumer has the meaning given in the ACL.
Goods means Machines, Consumables and Parts.
Included Care Plan means the one-year all-inclusive service contract included in the price of a new WaxJet 51C or WaxJet 530, described in clause 4.3 and in the Service Plan Terms.
Installation Date has the meaning in clause 9.5.
Machine means a Flashforge WaxJet printer we supply.
Parts means genuine Flashforge spare parts.
Quote means our written quote for the Goods and Services, including any changes we both agree in writing.
Service Plan means Boundless Labour, a Care Plan or the Included Care Plan.
Service Plan Terms means our Service Plan Terms.
Services means installation, training, repairs, maintenance, support and Service Plans.
Site means the delivery and installation address stated in the Quote.
Sydney Metro Area means locations within a 50 km straight-line radius of the Sydney GPO (1 Martin Place, Sydney NSW 2000).
Warranty means the 3D Werk Warranty Against Defects.
2.2 Headings are for convenience only. "Including" and similar words do not limit what comes before them.
3
Quotes, orders and acceptance
3.1 A Quote is valid for 30 days from its date, unless it says otherwise.
3.2 You accept a Quote by signing it or by confirming your acceptance in writing (email is fine) before it expires. We then send you a tax invoice for the full price.
3.3 Our contract is formed when we confirm in writing that we accept your order. We will not place your order with Flashforge until we have received full payment in cleared funds.
3.4 If we do not receive full payment within 5 Business Days after we send the tax invoice, either of us may cancel the order by written notice, at no cost to either of us.
3.5 Once our contract is formed, the price in the Quote is fixed. We will not increase it, even if our costs or exchange rates change.
3.6 If a Quote contains an obvious error (for example a clear typing mistake in a price), we will tell you before we accept your order and give you a corrected Quote, which you can accept or decline. We will not correct an error after acceptance to your disadvantage unless you agree.
3.7 If our contract is an unsolicited consumer agreement under the ACL (for example, because it was negotiated during a visit or phone call that you did not invite), you have the cooling-off and other rights the ACL gives you. In that case we will not ask for or accept payment, or supply any Goods or Services, until the cooling-off period has ended, and clause 3.4 runs from the end of that period.
4
Price, GST and what is included
4.1 Prices are in Australian dollars and include GST unless the Quote says otherwise. We will give you a tax invoice.
4.2 We do not add a surcharge for paying by card or through our online payment providers.
4.3 Unless the Quote says otherwise, the price of a new Flashforge WaxJet 51C or WaxJet 530 includes:
the Machine, as described in the Quote;
importation, freight to Sydney, customs clearance, duties and import charges;
delivery to the Site if the Site is in the Sydney Metro Area;
installation and setup at the Site, including a test print;
user training at the Site on the Installation Date or on dates we agree; and
the Included Care Plan for 12 months from the Installation Date, including quarterly preventive maintenance, as set out in the Service Plan Terms.
4.4 Delivery, installation, setup and training, including our travel to attend the Site, are included anywhere in the Sydney Metro Area. We supply Machines for a Site outside the Sydney Metro Area only if we agree in writing first. In that case:
delivery, installation, setup and training, and our reasonable travel and accommodation costs, are quoted separately and shown in the Quote before you accept it; and
under the Included Care Plan, Parts, remote support and diagnosis remain included, while on-site visits (including preventive maintenance) are by arrangement, with travel and accommodation costs quoted to you for approval before we travel.
4.5 For a WaxJet 530, the Included Care Plan gives you the benefits of a Care Plan WJ530. Everything else in clauses 4.3 and 4.4 applies to the WaxJet 530 in the same way as to the WaxJet 51C.
4.6 Anything not listed in the Quote is not included. For example: building work, benches, electrical work, network cabling, ventilation, air conditioning, isopropyl alcohol (IPA), cleaning materials, and Consumables beyond any starter quantity stated in the Quote.
5
Payment
5.1 For a Machine, the full Quote price is payable within 5 Business Days after we send the tax invoice under clause 3.2. We do not take a deposit.
5.2 Consumables and Parts are payable in full with your order, unless the Quote says otherwise.
5.3 You can pay by bank transfer or through our online payment providers (Stripe, Square or PayPal). We never store full card numbers. For Machines we recommend bank transfer.
5.4 Before making a first bank transfer, or if you receive a message saying our bank details have changed, always confirm our details by phoning us on +61 485 696 050. We will never change our bank details by email alone.
5.5 Other amounts that become payable under these Conditions (for example agreed travel costs, or costs under clause 8.4) are payable within 14 days after we invoice them.
5.6 If an amount is not paid by its due date, we may charge interest on it from the due date until it is paid, at the Reserve Bank of Australia cash rate target plus 4% per year, calculated daily. We may also recover our reasonable costs of recovering the overdue amount, such as debt collection and legal costs actually incurred.
5.7 If an amount is overdue, we may give you written notice asking you to pay within 5 Business Days. If you do not pay by then, we may suspend delivery, installation, training or other Services under that order until you pay, and we will resume promptly once you do. We will not suspend for an amount you are genuinely disputing in good faith under clause 23, if you pay any part that is not in dispute.
6
Cancellation
6.1 Before we place your order with Flashforge. We aim to place your order with Flashforge within 2 Business Days after we receive full payment, and we will tell you when we have done so. If you cancel by written notice before we place that order, we will refund everything you have paid within 10 Business Days.
6.2 After we place your order with Flashforge, and before delivery. You can still cancel by written notice. We will refund what you have paid, less our reasonable costs and losses caused by the cancellation, such as cancellation or restocking charges from Flashforge, freight, insurance, customs and import charges already incurred, and any reasonable loss on resale of the Machine. We will give you an itemised statement of these amounts and pay the refund within 10 Business Days after they are known. If we resell the Machine at the same or a better price, we will reduce the amount we keep accordingly. We never keep any part of your payment as a flat fee or penalty.
6.3 After delivery. You cannot cancel for a change of mind once the Machine has been delivered to the Site. This does not affect your rights under the ACL, clause 7.4 (delay) or clause 21 (events beyond control).
6.4 Cancellation by us. If we cannot supply the Goods (for example because Flashforge stops making the model or will not supply it to us), we will tell you promptly in writing, cancel the affected order and refund everything you have paid for Goods and Services we have not supplied within 10 Business Days. We will not charge you any cancellation cost.
7
Importation and lead times
7.1 We import Machines from Flashforge, the manufacturer, in China, by air freight into Sydney. Our usual lead time is about 6 weeks on average after we place your order with Flashforge, though it can be longer.
7.2 Any lead time or delivery date we give you is an estimate made in good faith, not a guarantee. Freight, customs, biosecurity, supplier and other delays can occur that we do not control.
7.3 We will keep you informed, including when your Machine leaves the factory, arrives in Sydney and clears customs, and we will tell you promptly in writing if we expect a delay, with a revised estimate.
7.4 If delivery of the Machine is more than 12 weeks later than the estimated delivery date we first gave you in writing, either of us may cancel the affected order by written notice. We will then refund everything you have paid for Goods not yet delivered and Services not yet performed, without any deduction, within 10 Business Days or, if we have already paid Flashforge, within 5 Business Days after Flashforge refunds us, and in any case within 30 days after cancellation.
7.5 Clause 7.4 does not apply to a delay caused by you, such as a delay in preparing the Site or in accepting delivery.
8
Site preparation
8.1 With our order confirmation we will send you the manufacturer's site requirements for your Machine. The WaxJet 51C weighs about 115 kg unpacked and about 140 kg in its crate. The WaxJet 530 weighs about 480 kg unpacked, and more in its crate. Both need a suitable site.
8.2 You must, at your cost, have the Site ready on the agreed delivery date, including:
clear, safe access from the street to the installation location for the crate and handling equipment, including lifts, ramps and doorways;
a stable, level bench or stand rated for the Machine's weight, of the size we specify;
the power supply the manufacturer specifies, installed by a licensed electrician where needed;
a room kept within the temperature and humidity range in the manufacturer's instructions;
a network connection, if you want network or remote support features;
adequate ventilation for the Machine and for post processing, including IPA baths; and
any building, landlord or strata permissions you need.
8.3 Please tell us before you accept the Quote about anything that may affect delivery or installation, such as stairs, narrow access, loading dock bookings or site inductions.
8.4 If the Site is not ready on the agreed date, or we cannot safely deliver or install because of something within your control, we will agree a new date with you as soon as reasonably possible, and you pay our reasonable additional costs actually incurred (such as a return visit, redelivery, extra handling equipment and reasonable storage while we hold the Machine for you). We will tell you the amount and the reason before we charge it wherever we reasonably can, and we will take reasonable steps to keep these costs low.
9
Delivery, installation and sign off
9.1 We will deliver the Goods to the Site on the date we agree with you, during business hours unless we agree otherwise.
9.2 For a Machine that includes installation, we will unpack, position and level it, connect it, run a test print and provide user training.
9.3 When installation is complete, we will ask you to sign an installation sign off confirming that the Machine has been installed and has completed a test print. If the Machine does not work as it should, please record the issue on the sign off. If the issue stops the Machine from printing, we will fix it and repeat the test print before sign off. Minor issues that do not stop the Machine from printing (such as a cosmetic mark or an adjustment that can be made later) do not delay sign off, and we will fix them promptly under the Warranty.
9.4 If you do not sign the sign off, or tell us in writing about an issue that stops the Machine from printing, within 5 Business Days after we tell you installation is complete, the sign off is treated as given on the day we told you.
9.5 The Installation Date is:
the date of the sign off under clause 9.3 or 9.4;
if we are not installing the Machine, the date it is delivered to the Site; or
if installation is delayed after delivery for reasons within your control, the date 14 days after delivery, if that is earlier.
9.6 Signing the sign off does not affect your rights under the ACL or the Warranty. It only fixes the Installation Date.
9.7 Where we are not installing the Machine, please inspect the Goods on delivery and tell us about any visible damage or shortfall within 5 Business Days, so we can fix it quickly and claim from the carrier. This is a request, not a condition. It does not limit your rights under the ACL.
10
Risk
10.1 Risk of loss of or damage to the Goods passes to you when they are delivered to the Site. From then on, please keep the Goods insured.
10.2 Until delivery, we are responsible for the Goods, including while they are in transit and in storage by us.
10.3 Clause 10.1 does not affect our responsibility for loss or damage that we, our staff or our contractors cause while installing, servicing or moving the Machine.
11
Ownership and security
11.1 Ownership of the Goods passes to you on delivery to the Site, provided we have received payment in full in cleared funds for those Goods and the Services supplied with them under the same order. If we have not, ownership passes when we receive full payment.
11.2 Until ownership passes to you, you hold the Goods for us, must keep them at the Site, insured and identifiable as ours, and must not sell, lease, lend, charge or otherwise deal with them. If an amount for the Goods is overdue and you do not pay it within 10 Business Days after our written notice, we may recover the Goods. For that purpose, you permit us to enter the Site during business hours, after giving you at least 2 Business Days' written notice. We will take reasonable care to avoid damage to your premises, and we will credit you with the reasonable value of recovered Goods (after our reasonable recovery and resale costs) against what you owe, refunding any surplus.
11.3 Where clause 11.2 applies, these Conditions create a security interest in the Goods and their proceeds under the Personal Property Securities Act 2009 (Cth) (PPSA), which is a purchase money security interest to the extent it secures the price. You consent to us registering it on the Personal Property Securities Register and will give us any information we reasonably need (such as your correct legal name and ABN or ACN). We will register only if an amount for the Goods is unpaid when they are delivered, we will pay the cost of registering, and we will remove the registration within 10 Business Days after you have paid in full.
11.4 To the extent the PPSA allows and the Goods are not used predominantly for personal, domestic or household purposes, you agree that sections 95 (notice only), 118 (notice only), 121(4), 125, 130 (notice only), 132(3)(d), 132(4) and 135 of the PPSA do not apply, and you waive your right to receive a verification statement under section 157, where the Goods are registered as commercial property.
12
Your rights under the Australian Consumer Law
Your ACL rights come first
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. If you are a Consumer, nothing in these Conditions, the Warranty or any other document of ours takes those rights away, except as the ACL itself allows.
12.1 A business can be a Consumer under the ACL. Among other things, you are a Consumer when the goods or services cost less than A$100,000 (including GST), or they are of a kind ordinarily acquired for personal, domestic or household use. A business purchase of a WaxJet 51C is therefore usually a Consumer purchase.
12.2 Goods bought to resupply, or to use up or transform in trade or commerce in a process of production or manufacture, or in repairing or treating other goods, are not acquired as a Consumer. Wax used up in making jewellery or dental patterns may fall into this category. The consumer guarantees apply to those Goods only to the extent the ACL applies.
12.3 A WaxJet 530 costs more than A$100,000 and is not ordinarily acquired for personal use, so the consumer guarantees usually do not apply to the Machine itself. Services bought separately for it (such as a Care Plan WJ530) may still be a Consumer supply. Whether you are a Consumer always depends on the facts of your purchase, and clause 14 applies only where you are not.
13
Limit for goods and services used in business
13.1 A Machine, and the Parts and Services we supply for it, are not of a kind ordinarily acquired for personal, domestic or household use or consumption.
13.2 So, as section 64A of the ACL permits, if we fail to comply with a consumer guarantee (other than the guarantees under sections 51, 52 and 53 of the ACL about title, undisturbed possession and undisclosed securities), our liability is limited to:
for Goods, at our option: replacing the Goods or supplying equivalent goods; repairing the Goods; paying the cost of replacing the Goods or acquiring equivalent goods; or paying the cost of having the Goods repaired; and
for Services, at our option: supplying the Services again, or paying the cost of having them supplied again.
13.3 This limit does not apply if you establish that it is not fair or reasonable for us to rely on it.
14
If you are not a Consumer
14.1 This clause applies only to Goods and Services you do not acquire as a Consumer (for example a WaxJet 530).
14.2 To the extent the law allows, all conditions, warranties and terms implied by statute, general law or custom are excluded, other than those in these Conditions, the Quote and the Warranty. The Warranty still applies to your Machine in full.
14.3 To the extent the law allows, our total liability to you arising out of or in connection with the relevant order, whether in contract, tort (including negligence), under statute or otherwise, is limited to the total price you paid us for the Goods or Services that gave rise to the liability.
14.4 Clause 14.3 does not limit our liability for death or personal injury caused by our negligence, or for our fraud or wilful misconduct.
15
Indirect and consequential loss
15.1 This clause does not exclude or limit any right you have under the ACL that cannot be excluded or limited. In particular, if you are a Consumer, the ACL entitles you to compensation for reasonably foreseeable loss or damage caused by a failure to comply with a consumer guarantee, subject only to clause 13 where it applies.
15.2 Subject to clause 15.1, and to the extent the law allows, neither of us is liable to the other for indirect or consequential loss, including lost production, downtime or business interruption; lost profits, revenue, contracts or goodwill; lost, damaged or wasted metal, gemstones, castings, patterns or other materials; and delayed, lost or cancelled customer orders.
15.3 Clause 15.2 does not affect your obligation to pay for Goods and Services, or liability for death or personal injury caused by negligence, or for fraud or wilful misconduct.
15.4 Each of us must take reasonable steps to reduce any loss we suffer because of the other's failure to meet their obligations.
16
Your responsibilities
16.1 You must:
use, clean, store and maintain the Goods in line with the manufacturer's instructions, user manual and safety data sheets, and any written guidance we give you;
make sure the Machine is operated only by people who have been trained by us, or by someone we trained, and who have read the user manual;
comply with the work health and safety laws that apply to you, including safe handling and storage of IPA and other chemicals, heated IPA baths, ventilation, fire safety and suitable personal protective equipment;
keep the Machine in a suitable environment, within the temperature, humidity, power and network conditions in the manufacturer's instructions;
keep regular backups of your print files, designs and job data, because data stored on the Machine can be lost during a fault or repair; and
tell us promptly about any fault, and stop using the Machine if continuing could cause more damage or a safety risk.
16.2 We strongly recommend genuine Flashforge wax and Parts. You are free to use other materials, but damage or faults caused by non-genuine wax or parts are not covered by the Warranty or a Service Plan (this does not affect your rights under the ACL).
16.3 Our Jeweller's Guides are general information only. They do not replace the manufacturer's instructions, safety data sheets or your own safety assessment.
17
We stand in for the manufacturer
17.1 Flashforge makes the Machines in China and has no place of business in Australia. We import them, so under the ACL we are treated as the manufacturer.
17.2 This means we are responsible to you under the ACL both as supplier and as manufacturer. You deal with us for everything about your Goods, including guarantees, the Warranty, repairs and Parts. You never need to contact Flashforge, and where we need Flashforge's help, we arrange it.
18
Spare parts and repair facilities
Notice under section 58 of the Australian Consumer Law
Repair facilities and parts for the Machine would not be available after the end of 3 years from the date we supply the Machine to you. We will try to support Machines for longer where we reasonably can, but we do not promise to.
18.1 We give this notice in writing at the time you agree to buy the Machine, because these Conditions come with every Quote, and we repeat it on your tax invoice and on the installation sign off.
19
Software, remote access and camera
19.1 The Machine includes software and firmware made by Flashforge or its licensors. They are licensed to you, not sold, on Flashforge's licence terms, which we will give you on request.
19.2 We may install software and firmware updates, including during installation or service visits, where we reasonably consider them beneficial or necessary for the Machine's operation, safety or security. We will tell you before installing a major update and, where we reasonably can, let you delay it. We cannot promise that Flashforge will release any particular update.
19.3 You must not copy, modify, decompile or reverse engineer the software or firmware, except to the extent the law allows you to despite this restriction.
19.4 The Machine has a built-in camera and stores print files and job data. We access the Machine remotely, or view its camera, only with your permission at the time and only to provide support you have asked for. You can end remote access at any time. If you choose to use any online features offered by Flashforge, Flashforge handles that data under its own terms. Our Privacy Policy explains how we handle personal information.
20
Warranty and your designs
20.1 Machines, and Parts we fit, come with the 3D Werk Warranty Against Defects, which is given with these Conditions and is in addition to your rights under the ACL.
20.2 You own the intellectual property in the designs, files and products you create. We look at your files only when needed to provide Services you ask for, and we keep them confidential. You are responsible for having the right to print and cast the designs you use.
21
Events beyond control
21.1 Neither of us is liable for a delay or failure to perform an obligation (other than paying money) to the extent it is caused by an event beyond that party's reasonable control, such as natural disaster, fire, flood, pandemic, war, industrial action (other than by that party's own staff), government action, border or port closure, or failure of air freight or customs systems.
21.2 The affected party must promptly tell the other in writing, explain the likely effect and take reasonable steps to reduce it.
21.3 If the event prevents performance for more than 60 consecutive days, either of us may cancel the affected order by written notice, and we will refund everything you have paid for Goods not yet delivered and Services not yet performed, without any deduction, within 10 Business Days or, if we have already paid Flashforge, within 5 Business Days after Flashforge refunds us, and in any case within 30 days after cancellation. This clause does not reduce your rights under clause 7.4.
22
Default and termination
22.1 Either of us may end an order by written notice if the other:
commits a material breach of these Conditions and does not remedy it within 10 Business Days after written notice describing the breach; or
becomes insolvent, to the extent the law allows an order to be ended for that reason.
22.2 If you end an order because of our breach, we will refund everything you have paid for Goods not yet delivered and Services not yet performed, without affecting your other rights.
22.3 If we end an order because of your breach, clause 6.2 applies as if you had cancelled, and clause 11 continues to apply to Goods not yet paid for.
22.4 Ending an order does not affect rights that arose before it ended, or clauses that by their nature continue (including clauses 11 to 15, 20 and 23).
23
Disputes
23.1 If you have a concern, please talk to us first. We aim to respond within 1 Business Day and to resolve the matter within 10 Business Days.
23.2 If we cannot resolve it by talking, either of us may propose mediation by an independent mediator we both agree on. Each of us pays our own costs and we share the mediator's fees equally, unless we agree otherwise.
23.3 Mediation is an option, not a precondition. Nothing in this clause stops either of us from contacting NSW Fair Trading, going to a tribunal (including the NSW Civil and Administrative Tribunal) or court, or seeking urgent relief at any time.
24
General
24.1 Notices. Notices must be in writing and may be sent by email. Our email for notices is support@3dwerk.com.au. Yours is the email in the Quote or another address you tell us in writing. An email received after 5 pm, or on a day that is not a Business Day, is treated as received on the next Business Day.
24.2 Entire agreement. The Quote and these Conditions (with the documents they refer to) are our entire agreement about your order. This does not exclude any right you have under the ACL, or liability for any representation that the law does not allow to be excluded.
24.3 Severability. If any part of these Conditions is void, unenforceable or unfair under law, it is severed and the rest continues to apply.
24.4 No waiver. Not enforcing a right straight away does not waive it. A waiver must be in writing.
24.5 Assignment and subcontractors. Neither of us may transfer rights or obligations under an order without the other's written consent, which must not be unreasonably withheld. We may use subcontractors (such as carriers and licensed electricians), and we remain responsible for their work.
24.6 Governing law. These Conditions are governed by the law of New South Wales. Each of us submits to the non-exclusive jurisdiction of the courts and tribunals of New South Wales. This does not limit any right you have to use a tribunal or court elsewhere where the law gives you that right.
24.7 Changes. We may update these Conditions by publishing a new version on our website. A change applies only to Quotes we issue after it is published. Your order stays on the Conditions that came with your Quote.
