Section 1

1

About these terms

1.1 These Terms and Conditions are between you and 3D Werk (ABN 68 663 371 015), of Sydney NSW (we, us, our). "You" means the person using our website or placing an order and, if you order for a business, that business.

1.2 These terms apply to:

your use of our website www.3dwerk.com.au (the website); and

orders for Consumables and Parts placed through the website, by email or by phone.

1.3 In these terms and in our other policies:

ACL means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth);

Business Day means a day other than a Saturday, Sunday or public holiday in New South Wales;

Consumables means wax and other materials used up in printing;

Consumer has the meaning given in the ACL;

Goods means Machines, Consumables and Parts;

Machine means a Flashforge WaxJet printer we supply;

Parts means genuine Flashforge spare parts;

Service Plan means Boundless Labour, a Care Plan, or the one-year service contract included with a new WaxJet 51C or WaxJet 530;

Services means installation, training, repairs, maintenance, support and Service Plans; and

Sydney Metro Area means locations within a 50 km straight-line radius of the Sydney GPO (1 Martin Place, Sydney NSW 2000).

1.4 Machine purchases are governed by our Conditions of Sale: Machines and Equipment, Service Plans by our Service Plan Terms, and one-off repairs by our Repair and Callout Terms. If one of those documents conflicts with these terms about a Machine, Service Plan or repair, that document applies.

Section 2

2

Using our website

2.1 You can browse our website without creating an account or agreeing to buy anything. While you use it, please:

do not use the website for any unlawful purpose;

do not try to interfere with, overload or gain unauthorised access to the website, our store or our Request Service app;

do not upload viruses or harmful code; and

do not copy large parts of the website or scrape it with automated tools.

2.2 We try to keep the website available and accurate, but it may occasionally be unavailable for maintenance or for reasons outside our control.

Section 3

3

Accounts and sign-in

3.1 Some features, such as the online store, Service Plan subscriptions and our Request Service app, need you to create an account or sign in.

3.2 Please give us accurate details, keep your password secure and tell us promptly if you think someone else has used your account. You are responsible for activity on your account that you authorise, including by sharing your login with colleagues.

3.3 We may suspend an account if we reasonably believe it is being misused or used fraudulently. We will tell you why, unless the law or a security concern prevents us.

Section 4

4

Product information

4.1 We take care to describe our Goods accurately. Images are for illustration, and small differences in colour or packaging may occur. The manufacturer may update specifications. If a detail matters to you, please ask us before ordering.

4.2 Flashforge, WaxJet and related names and logos are trade marks of their owner. We use them only to identify the genuine Flashforge products we supply. We are an independent supplier and do not claim any rights in those trade marks.

Section 5

5

Prices

5.1 All prices are in Australian dollars and include GST unless stated otherwise.

5.2 Delivery charges for Consumables and Parts are shown at checkout or in our quote before you place your order.

5.3 We do not add a surcharge for paying by card or through our online payment providers.

5.4 Website prices may change, but the price that applies to your order is the price shown when you placed it, subject to clause 6.4.

Section 6

6

Online orders for Consumables and Parts

6.1 When you place an order, you make an offer to buy the Goods listed. We accept your offer when we send you an email confirming that your order is accepted or has been dispatched. A contract is formed at that point.

6.2 An automatic email saying we have received your order is not an acceptance.

6.3 We may decline an order before we accept it, for example if the Goods are unavailable, we cannot verify payment or the delivery address is outside the areas we deliver to. If we decline an order, we refund everything you paid.

6.4 If a price on the website is clearly wrong because of an obvious error (for example a missing digit), we will contact you before we accept the order. You can then go ahead at the correct price or cancel, and we will refund anything you have paid.

6.5 If after accepting your order we find we cannot supply some or all of the Goods, we will tell you promptly and let you choose between waiting (where a new supply date is expected) or cancelling the affected items for a full refund.

Section 7

7

Machines and Service Plans

7.1 Orders for Machines, including the Flashforge WaxJet 51C and WaxJet 530, are governed by our Conditions of Sale: Machines and Equipment, which cover Quotes, payment, delivery, installation, ownership, spare parts and liability.

7.2 Service Plans, including Boundless Labour and the Care Plans, are governed by our Service Plan Terms, which cover inclusions, billing, renewal, cancelling and service targets.

7.3 We make the relevant document available to you before you order, and we ask you to confirm that you have read it.

Section 8

8

Payment

8.1 Consumables and Parts are paid for in full when you order.

8.2 We accept card and digital wallet payments through Stripe, Square and PayPal, and bank transfers. Our payment providers process card payments, and we do not store full card numbers.

8.3 If you pay by bank transfer, we dispatch your order once the funds have cleared.

Section 9

9

Delivery, risk and returns

9.1 Delivery areas, timeframes, checking your delivery, and when risk and ownership pass to you are set out in our Shipping, Delivery and Installation Policy, which forms part of these terms.

9.2 How to report a problem and how refunds are paid are set out in our Returns and Refunds Policy, which also forms part of these terms.

Section 10

10

Your rights under the Australian Consumer Law

Your consumer rights

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms, or in any other document we give you, takes away your rights under the Australian Consumer Law.

10.1 Services also come with consumer guarantees, including that they will be provided with due care and skill, be fit for any purpose you made known to us and be supplied within a reasonable time.

10.2 Whether the consumer guarantees apply depends on your purchase. A business purchase is generally covered if the goods or services cost less than A$100,000 (including GST), or the goods or services are of a kind ordinarily acquired for personal, domestic or household use. Goods bought to resupply, or to use up or transform in production or manufacturing, or in repairing other goods, are generally not covered. For example, wax used up to make jewellery or dental patterns may fall into that category. These terms apply to the extent the ACL applies to your purchase.

Section 11

11

Limits on our liability

11.1 This clause applies only to the extent the law allows, and is subject to clause 10.

11.2 Our Parts and Services are not of a kind ordinarily acquired for personal, domestic or household use or consumption. So, as section 64A of the ACL permits, our liability for a failure to comply with a consumer guarantee (other than the guarantees as to title, undisturbed possession and undisclosed securities) is limited, at our option, to:

for Parts: replacing the Parts or supplying equivalent parts, repairing the Parts, or paying the cost of replacing the Parts, acquiring equivalent parts or having the Parts repaired; and

for Services: supplying the Services again, or paying the cost of having them supplied again.

This limit does not apply if you establish that it is not fair or reasonable for us to rely on it.

11.3 Except where the ACL gives you a right to compensation that cannot be excluded, neither of us is liable to the other for indirect or consequential loss, or for loss of profits, revenue, production, business or data, arising from use of the website or the Goods or Services.

11.4 Nothing in this clause limits liability for death or personal injury caused by negligence, or for fraud.

11.5 Our liability is reduced to the extent a loss is caused or contributed to by you, for example by not following the manufacturer's instructions or our reasonable directions.

Section 12

12

Guides and technical information

12.1 Our Jeweller's Guides, articles, videos and other technical information are general information only. We prepare them with care, but they are not tailored to your business, equipment or site, and they are not professional safety, engineering or legal advice.

12.2 Always follow the manufacturer's instructions and the safety data sheet for every product, chemical and material you use, including wax, isopropyl alcohol (IPA) and cleaning agents. If a guide and the manufacturer's instructions differ, follow the manufacturer's instructions.

12.3 Some processes in our guides, such as washing parts in warm IPA, involve flammable liquids and vapours. As the business operating the equipment, you remain responsible for work health and safety at your site, including risk assessment, ventilation, ignition source control, storage, personal protective equipment, training and safe disposal.

12.4 If you are unsure about any process, please contact us before you start.

Section 13

13

Intellectual property

13.1 The content of our website, including text, guides, graphics, photos and layout, is owned by us or used under licence. You may view, download and print it for your own business or personal use, including sharing our guides within your own business.

13.2 You must not republish, sell or use our content commercially, or present it as your own, without our written permission.

13.3 We do not claim any rights in your designs or print files.

Section 14

14

Third-party links

Our website may link to websites run by others, such as Flashforge or our payment providers. We do not control those websites and are not responsible for their content or privacy practices. A link is not an endorsement.

Section 15

15

Who can order

You must be 18 or older to place an order. If you order for a business, you confirm that you are authorised to do so and to accept these terms for that business.

Section 16

16

Privacy

We handle personal information in line with our Privacy Policy, which explains what we collect, why, and how you can access or correct it.

Section 17

17

Changes to these terms

17.1 We may update these terms, for example to reflect changes in the law, our products or the way we do business. Updated terms are published on this page with a new date.

17.2 Updated terms apply only to orders placed after they are published. They never change an order we have already accepted.

Section 18

18

General

18.1 These terms are governed by the law of New South Wales, Australia. Each of us submits to the non-exclusive jurisdiction of the courts and tribunals of New South Wales.

18.2 If any part of these terms is invalid or unenforceable, it is read down or severed to the extent necessary, and the rest continues to apply.

18.3 If we do not enforce a right straight away, we have not given it up.

18.4 If we cannot perform an obligation because of an event beyond our reasonable control, such as a freight or customs delay, natural disaster or supplier shutdown, we will tell you as soon as practicable and resume as soon as we can. Your rights under the ACL are not affected.
